Terms of Use

1. Accepting these terms

By downloading or using Brainzy, you accept these terms and our Privacy Policy. If you do not agree with them, please do not use Brainzy. Apple’s Media Services Terms and Conditions also apply to the app you download from the App Store.

2. What Brainzy is

Brainzy is a daily puzzle game. Every day it offers the same six puzzles to every player, times your games, awards points and XP, and lets you compare your results with friends and with the world.

Brainzy needs an internet connection to load the day’s puzzles and the rankings. The app is free; it is funded by advertising and by an optional purchase.

3. Who can play

Brainzy is for personal, non-commercial use. You must be at least 13 years old — or older where your country requires it (15 in France) — or have the agreement of a parent or guardian.

4. Your account

A guest account is created for you when you first open the app. You can link it to Sign in with Apple or Google Sign-In to keep your progression across devices.

Your username is public. It must not impersonate someone else, nor be insulting, hateful, sexual or infringing. The same goes for your profile photo. We may ask you to change either, or change it ourselves, if it breaks this rule.

You are responsible for what happens on your account. You can delete it at any time from Settings › My account — see our account deletion page.

5. Playing fair

Each daily game is played once a day: whether you win or lose, it comes back tomorrow with a new puzzle. Points are calculated by our servers from your result, and become the XP that builds your level and grade.

We may adjust puzzles, scoring, levels and rankings to keep the game fair and enjoyable. A result that is technically impossible can be refused, and a suspicious one reviewed. Rankings are for fun: they give no right to any prize.

6. Coins and Hints

Coins are an in-game currency. You earn them by solving puzzles and, where offered, by choosing to watch a rewarded ad. You can spend them on a Hint, which reveals one step of the grid and adds a few seconds to your time. The amounts and limits are shown in the app and can change.

Coins cannot be bought, have no monetary value, cannot be transferred or exchanged for money or anything else, and are not refundable. They are a limited, personal licence to use a feature of the game, and they disappear with your account. We may correct a balance affected by an error or by abuse.

7. Advertising

Brainzy is free and shows advertising, served by Google AdMob. Ads are never shown during a game. Ads are never personalized, as explained in our Privacy Policy. We are not responsible for the content of third-party ads or for the sites they lead to.

8. Remove Ads

Remove Ads is a one-time purchase. It is a non-consumable in-app purchase: there is no subscription, no automatic renewal and nothing to cancel. Once bought, it turns off advertising in the app for good, including rewarded ads. The price is shown by the App Store before you confirm.

The purchase is sold and processed by Apple, under Apple’s terms. It is tied to your Apple ID, not to your Brainzy account: you can restore it on another device from Settings › Remove Ads › Restore Purchases, and it survives deleting your Brainzy account.

Refunds are handled by Apple (reportaproblem.apple.com). As the content is delivered immediately, the legal right of withdrawal does not apply once the purchase is complete, which you accept at the time of purchase.

9. Intellectual property

Brainzy — its name, logo, design, puzzles, texts, sounds and software — is protected by intellectual property law and belongs to us or to our licensors. We grant you a personal, non-exclusive, non-transferable and revocable licence to use the app for what it is made for. You are welcome to share screenshots and your results.

10. What you must not do

• Cheat, or use a bot, a script or any tool that plays for you or alters a result.
• Exploit a bug to gain an advantage — tell us about it instead.
• Create accounts in bulk, or disturb the service and its servers.
• Copy, decompile or reverse-engineer the app, except where the law allows it.
• Harass other players, or use an inappropriate username or photo.

11. Suspension and termination

You can stop using Brainzy whenever you like, and delete your account from the app. We may suspend or delete an account, or remove results from the rankings, in case of a serious or repeated breach of these terms — cheating in particular — and we will tell you when we can.

12. Availability

We do our best to keep Brainzy running every day, but we cannot promise it will never be interrupted: maintenance, updates, a provider’s outage or something outside our control can happen. Brainzy can also change over time, as games and features are added, altered or removed.

13. Liability

Brainzy is provided as it is. To the extent the law allows, we are not liable for indirect damage, loss of data, loss of progression or interruptions of the service. Nothing here limits your rights as a consumer, nor our liability where it cannot legally be limited.

14. Changes to these terms

We may update these terms. The date at the top of the page changes, and we tell you in the app about anything significant. Continuing to play after an update means you accept the new terms.

15. Governing law and disputes

These terms are governed by French law, without depriving you of the protection of the mandatory rules of your country of residence.

If something goes wrong, please write to us first at hello@playbrainzy.com: most things are settled that way. You can also bring the matter before the competent courts.
